Last Updated: September 2026. These Terms of Engagement ("Terms") govern your access to and use of websites, digital scanners, and advisory services operated by Pinnacle9 AI Technologies Pvt Ltd ("Pinnacle9").
1. Acceptance & Scope of Services
By accessing this website, utilizing our online AI Visibility Audit scanner, or executing a Statement of Work (SOW) with Pinnacle9, you agree to be bound by these Terms. If you are entering into this agreement on behalf of an enterprise or legal entity, you represent that you possess the authority to bind such entity.
Pinnacle9 provides strategic management advisory, Generative Engine Optimization (GEO) engineering, enterprise workflow automation, and custom copilot development services.
2. Intellectual Property Rights & Deliverables
Client Ownership: Clients retain exclusive ownership of all proprietary data, trade secrets, confidential internal documentation, and custom operational agent pipelines developed specifically for their organization under executed commercial agreements.
Pinnacle9 Methodology: Pinnacle9 retains all rights, title, and interest in its pre-existing diagnostic algorithms, benchmark taxonomies, testing scripts, and proprietary frameworks, including the P9 AI Visibility Score™ and P9 AI Opportunity Map™ methodologies.
3. Nature of Diagnostic Audits & Third-Party AI Platforms
Our diagnostic scanning tools execute real-time observational queries against third-party generative search engines (such as Google Gemini, OpenAI ChatGPT, Perplexity AI, and Anthropic Claude).
You acknowledge that third-party AI models operate dynamically based on probabilistic algorithms, periodic training updates, and real-time web retrieval. Pinnacle9 does not own or control these third-party foundation models. Diagnostic audit results reflect point-in-time observations and technical crawl evaluations.
4. Confidentiality & Mutual Non-Disclosure
All proprietary business information, operational metrics, and architecture diagrams disclosed during advisory discussions or commercial engagements are held in strict confidence. Formal advisory contracts are governed by bilateral Non-Disclosure Agreements (NDAs).
5. Limitation of Liability
To the maximum extent permitted by applicable law, Pinnacle9 AI Technologies Pvt Ltd shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data loss, or business interruption arising out of or in connection with the use of our website, diagnostic tools, or third-party AI platform outages.
6. Governing Law & Jurisdiction
For contracts executed with our Indian entity, these Terms shall be governed by and construed in accordance with the laws of India, and disputes shall be subject to the exclusive jurisdiction of the competent courts in Chennai, Tamil Nadu.
For contracts executed with our United States entity, engagements are governed by the laws of the Commonwealth of Virginia.
